Salerno Awarded Millions

A federal jury in Kansas City awarded $4.9 million to Siro Smith Dickson’s client, Rosemary Salerno, a former general manager of Zona Rosa shopping center, for wrongful termination due to her whistle-blowing reports of alleged violations of law and public policy. Ms. Salerno alleged she was fired after refusing to divert parking meter funds designated for charity into the shopping center’s operating funds. Her termination came shortly after receiving a positive performance review and a raise. The verdict included $439,000 in damages, $500,000 for pain and suffering, and $4 million in punitive damages.

MPI Management, operating as Olshan Properties, is also responsible for covering Salerno’s legal fees. Ms. Salerno’s lead attorney, Athena Dickson, highlighted violations of the Missouri Human Rights Act and whistleblower retaliation. The decision follows a prior Platte County ruling also in Salerno’s favor after Olshan sued her for allegedly misusing company funds, a claim she denied and the Judge dismissed.

“We feel like Ms. Salerno was heard,” Ms. Dickson said, referring to the evidence showing multiple layers of alleged unethical and illegal activity. “I think Ms. Salerno was pleased that the jury was able to recognize her credibility and good work history as a long-time employee.” Ms. Salerno’s employment as General Manager at Zona Rosa dated back about 14 years prior to the facts at issue in the lawsuit.
